CWA approves quitclaim of Bonsall easement

The San Diego County Water Authority approved a quitclaim of the SDCWA’s access road easement on a property in Bonsall.

The June 26 approval by the CWA board authorizes the quitclaim of the road easement to property owners Terry J. Brown and Michael S. Hefner. The property, which is west of the CWA’s Second Aqueduct, is located in the 31400 block of Aqueduct Road.

On June 30, 1961, the CWA entered into an agreement with the property owner at that time for an access roadway. Although no compensation was provided to the property owner, the CWA agreed to maintain the roadway in good condition for travel by ordinary vehicles and also agreed to repair any damage to the roadway which resulted from CWA use.

After access within the Second Aqueduct across the property was developed, the access easement was no longer necessary. The CWA has not used or maintained the easement in more than 25 years and no CWA facilities exist along the easement.

The quitclaim terminates the CWA’s obligation to maintain the road. Because no compensation was paid for the easement, the CWA received no compensation for the quitclaim.
