Court orders $2.5 million in damages to Kirk

SAN DIEGO – In January, a San Diego Superior Court jury ordered that Fallbrook businessman Guido DiMitri pay $3.7 million in compensatory damages and $2.5 million in punitive damages to his real estate partnership and business partner, Mark Kirk.
Kirk and DiMitri had formed a limited partnership, DiMitri, Diffendale & Kirk, LLP, several years ago to develop various residential properties in Fallbrook for resale. Kirk’s lawsuit charged that DiMitri engaged in a fraudulent scheme to take over the property for his own personal gain at the expense of the partnership.
