MURRIETA (CNS) - Jury selection began today for the trial of a 23-year-

old Lake Elsinore man who allegedly caused head injuries to a 5-month-old baby

by shaking her and throwing her into a playpen.

David Anthony Gutierrez is facing felony charges of causing corporal

injury to a child, with great bodily injury and serious felony allegations.

The first group of prospective jurors was brought into the courtroom

shortly after 10 a.m.

In a pretrial ruling, a judge determined that statements that Gutierrez

made to a detective, in which he allegedly admitted that he had hurt the

infant, will be admissible.

Gutierrez was arrested at Riverside County Regional Medical Center on

Aug. 27, 2008, after he told sheriff's investigators that he shook the baby and

then threw the child head-first into a playpen, which caused head trauma,

sheriff's Sgt. Michael Yates said earlier.

The defense asked that the statements made to Detective Tina Woodard

during the interview be withheld, but the prosecution's motion to include them

as evidence was granted.

The alleged violence took place at the child's home in Lake Elsinore.
